End User License Agreement (EULA)

This End User License Agreement (“Agreement”) is a legal agreement between you (“you” or “the user”) and KYP Studio AS, Norway (“KYP Studio”, “we”, “us”, or “our”), governing your use of the iOS application A Season of Joy (the “App”).

1. Scope and acceptance

By downloading, installing, or using A Season of Joy, you agree to be bound by this Agreement and our Privacy Policy. If you do not agree to these terms, do not use the App.

This Agreement applies solely to A Season of Joy and does not govern any other products or services provided by KYP Studio AS.

1.1 Updates to this Agreement

We may update this Agreement from time to time. When we do, the “Last updated” date at the top will be revised. Your continued use of the App after such changes constitutes acceptance of the updated Agreement.

2. License

KYP Studio AS grants you a limited, non-exclusive, non-transferable, and revocable license to use A Season of Joy on Apple-branded devices that you own or control, in accordance with Apple’s App Store Terms of Service.

3. Nature of the App

A Season of Joy is intended as a personal wellbeing and reflection tool designed to support calm interaction and everyday reflection.

The App is not a medical, therapeutic, or diagnostic tool and does not provide health advice or treatment. You remain solely responsible for how you interpret and use any content, prompts, or activities presented in the App.

Access to paid features or subscriptions does not change the non-medical, non-therapeutic nature of the App.

The App is not intended to replace professional medical, psychological, or therapeutic advice.

4. User content and responsibility

The App allows you to create personal content, such as activities, notes, and preferences, for your own use.

You retain ownership of your content. KYP Studio AS does not access, read, analyze, or process your personal content.

You are responsible for ensuring that your use of the App complies with applicable laws and does not infringe the rights of others.

You agree not to use the App in any unlawful manner, or in a way that interferes with or disrupts its normal operation.

5. iCloud and data storage

If you enable iCloud synchronization, your content is stored in your private Apple iCloud account using Apple CloudKit. KYP Studio AS does not have access to your iCloud data or Apple ID.

Apple’s use of iCloud and CloudKit is governed by Apple’s own terms and privacy policies.

6. Subscriptions and purchases

A Season of Joy offers optional paid subscriptions (such as Joy Plus) that provide access to additional features.

Any in-app purchases or subscriptions are processed by Apple through the App Store. Payments, billing, cancellations, and refunds are handled by Apple in accordance with its App Store policies.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period.

You can manage or cancel your subscription through your Apple ID account settings.

Pricing, renewal terms, and refunds are governed by Apple’s App Store policies.

Features, content, and availability of the App may change over time. Your purchase or subscription is not conditional upon the delivery of any specific future functionality or feature.

Refunds, if any, are handled exclusively by Apple in accordance with its App Store policies.

7. Intellectual property

All intellectual property rights in A Season of Joy, including but not limited to design, text, graphics, and code, are owned by KYP Studio AS or its licensors.

You may not copy, modify, distribute, reverse engineer, or create derivative works of the App except as permitted by law.

8. Disclaimer of warranties

The App is provided “as is” and “as available”, without warranties of any kind, express or implied.

KYP Studio AS does not warrant that the App will be uninterrupted, error-free, or meet your expectations.

To the extent permitted by law, all implied warranties, including warranties of merchantability and fitness for a particular purpose, are disclaimed.

9. Limitation of liability

To the maximum extent permitted by law, KYP Studio AS shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of A Season of Joy.

KYP Studio AS’s total liability for any claim arising under this Agreement shall in no event exceed the total amount paid by you for the App or its subscriptions during the twelve (12) months preceding the event giving rise to the claim.

Nothing in this Agreement limits liability that cannot be excluded under applicable law.

10. Third-party terms (Apple)

This Agreement is between you and KYP Studio AS only, not Apple.

Apple is not responsible for the App or its content and has no obligation to provide maintenance or support services.

In the event of any failure of the App to conform to applicable warranties, you may notify Apple, and Apple may refund the purchase price, if any, in accordance with its policies. Apple has no further warranty obligation.

11. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically if you fail to comply with its terms.

KYP Studio AS reserves the right to suspend or discontinue access to the App, in whole or in part, at any time, with or without notice, for operational, legal, or security reasons.

Upon termination, you must cease all use of the App.

12. Governing law

This Agreement is governed by and construed in accordance with the laws of Norway, without regard to conflict of law principles.

Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Norway, with Trondheim District Court (Trondheim tingrett) as the agreed legal venue.

13. Severability and entire agreement

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and KYP Studio AS regarding the App.
